1. Who This Policy Covers

This policy applies to anyone who uses this website or the online stallholder platform at caloundra.tekram.com.au — including stallholders and vendors, entertainment and community applicants, people who submit an enquiry, and general website visitors.

It explains what information is collected, who holds it, who is responsible for it, and what you can do about it.

It does not cover information you give to Caloundra Markets outside this platform — in person at the market, by phone, by post, or through any other website.

2. The Parties Involved

Caloundra Markets — the market operator

Caloundra Chamber of Commerce & Industry inc (ABN 49 271 880 859), trading as Caloundra Markets, owns and operates the regular local markets on the Sunshine Coast, Queensland. Caloundra Markets decides who trades at the markets, allocates stall sites, sets market rules and fees, verifies insurance and licence compliance, and manages everything that happens on market day.

Caloundra Markets is the business responsible for the personal information collected through this platform. In this policy it is called the Market Operator.

TEKRAM — the software provider

TEKRAM (ABN 57 753 001 256) is an independent Australian technology company that builds and operates space allocation and booking software. It is owned and built by Gravity Projex, a digital marketing, software & web development business. TEKRAM supplies this booking platform to the Market Operator under a commercial software agreement, and supplies similar software to unrelated operators in other industries.

TEKRAM does not own, operate, staff, manage or hold any interest in Caloundra Markets. TEKRAM does not decide who gets a stall, does not allocate sites, does not set fees, and is not present at the markets. TEKRAM is not a partner, agent, subsidiary or joint venturer of the Market Operator, and the Market Operator does not own or control TEKRAM.

TEKRAM holds information on this platform on behalf of the Market Operator and only to run the platform. TEKRAM does not use stallholder information for its own marketing, does not share it with its other clients, and does not sell it. TEKRAM's own privacy policy is at tekram.com.au/privacy-policy.

The name on this website

This website is the vendor platform for Caloundra Markets. Where it says “powered by TEKRAM”, that refers to the booking software only — TEKRAM supplies the platform, and Caloundra Markets runs the markets. It does not indicate a merged, joint or shared business, and TEKRAM claims no interest in the Caloundra Markets name or business.

Caloundra Markets also operates its own separate website at https://caloundramarkets.com.au. This policy covers the booking platform only. Information you provide through their main website is covered by whatever privacy terms apply there.

3. Information We Collect

Information is collected through this platform because it is reasonably necessary for the Market Operator to run the markets.

What these terms mean

Personal information is information or an opinion about someone who is identified, or who could reasonably be worked out from it. It does not have to be written down, and it does not have to be correct.

Sensitive information is a category of personal information that the Privacy Act protects more strictly. It includes information about health, criminal record, racial or ethnic origin, religious or philosophical beliefs, political opinions or memberships, and biometric data. Sensitive information generally cannot be collected without your consent.

Stallholder and vendor information

  • Full name and trading name
  • Email address and phone number
  • Postal and business address
  • ABN or business registration details
  • Product descriptions and business category
  • Public liability insurance details and document uploads
  • Food handling licences or certifications, where applicable
  • Emergency contact details
  • Booking history and attendance records
  • Photos, logos, website and social media links you provide for the public vendor directory

Website and platform usage

  • IP address and browser or device type
  • Pages visited, time on site and referring URLs
  • Account login activity
  • Form submissions and enquiries

Sensitive information

Sensitive information is not routinely requested. Where a compliance document or an incident record contains sensitive information, it is collected by the Market Operator with your consent, given when you submit it, and only where it is reasonably necessary for market compliance, safety or permit conditions. It is used only for that purpose and access to it is restricted.

How information is collected

  • Directly from you when you complete an application, booking, incident report or contact form
  • When you create or use an account on the platform
  • Automatically through cookies and website analytics
  • From publicly available sources, such as ABN Lookup, to verify business details

Information you give us about other people

If you provide personal information about someone else — an emergency contact, a staff member who will work your stall, or a person named in an incident report — you confirm you are entitled to provide it and that they would reasonably expect it to be handled as described here. Please let them know.

Providing information is your choice

You are not obliged to provide personal information. If you choose not to, the Market Operator may be unable to assess your application, allocate you a site, or accept your booking.

4. How Your Information Is Used

By the Market Operator, to run the markets

  • Assessing and approving stallholder, entertainment and community applications
  • Allocating stall sites and planning the market layout
  • Verifying licences, insurance and compliance documents, and chasing expiry
  • Charging and reconciling market fees, and issuing invoices and receipts
  • Managing check-ins, no-shows and waitlists
  • Publishing approved vendors to the public vendor directory
  • Communicating about bookings, allocations, changes and cancellations
  • Recording and responding to incidents that occur at the market
  • Meeting venue, council, insurance and permit conditions

By TEKRAM, to run the platform

  • Providing, hosting and maintaining the platform
  • Authenticating your account and keeping it secure
  • Sending transactional messages the platform generates, such as booking confirmations and password resets
  • Providing technical support when requested by the Market Operator
  • Diagnosing faults and improving platform reliability and performance

TEKRAM does not use your information for any purpose beyond operating the platform for the Market Operator.

Secondary use

Your personal information will not be used for a secondary purpose unless that purpose is related to the primary purpose of collection and you would reasonably expect it, or you have consented, or it is required or authorised by law.

5. Payments

Card payments are processed by Stripe, a third-party payment provider. Full card numbers and CVV details are never stored on this platform. Transaction records such as amount, date and reference are retained for accounting and tax compliance.

Market fees are payable to, and received by, the Market Operator. The Stripe merchant account is held by Caloundra Markets and funds settle directly to them. TEKRAM does not receive, hold or handle market fee payments, and takes no percentage of any booking.

Stripe handles card data under its own privacy terms: stripe.com/au/privacy.

6. Disclosure of Information

Personal information may be disclosed to:

  • TEKRAM — as the software provider hosting and maintaining the platform
  • Stripe — for payment processing
  • Hosting and email providers — engaged by TEKRAM to store the platform and deliver its messages
  • Accountants, bookkeepers, insurers and legal advisers — where necessary for financial or legal purposes
  • Sunshine Coast Council, venue owners or site managers — where required by permit, venue or insurance conditions
  • Government agencies and regulators — where required or authorised by law, including in connection with legal proceedings

What does not happen

  • Personal information is not sold to third parties
  • Information is not shared for third-party marketing without your consent
  • Stallholder contact details are not published on the public website — only the business details you choose to include in your directory listing appear publicly
  • TEKRAM does not disclose your information to its other clients or use it across other markets

If a business changes hands

If the market business is sold or transferred, personal information may be transferred to the incoming operator so the markets can keep running. Any recipient would be required to handle it in accordance with the Australian Privacy Principles.

7. Overseas Storage & Processing

  • Hosting — the platform and its data are stored on Australian-based infrastructure
  • Payment processing — Stripe operates in Australia and the United States
  • Email delivery — transactional and broadcast email may be processed in the United States
  • Website analytics — Google Analytics 4, used on public pages only, may process data in the United States

Where information is disclosed to an overseas recipient, reasonable steps are taken under Australian Privacy Principle 8 to ensure it is handled consistently with the Australian Privacy Principles.

8. Data Security

TEKRAM maintains the technical security of the platform, applying practices aligned with recognised industry standards, including principles consistent with ISO/IEC 27001, without claiming formal certification. These include:

  • Encrypted connections (HTTPS/TLS) across the website and platform
  • Password-protected accounts with role-based access controls
  • Least-privilege access, granted on a need-to-know basis
  • Australian-based hosting infrastructure
  • Segregation of each operator's data from every other operator's
  • System monitoring, vulnerability management and regular software updates

The Market Operator is responsible for the security measures within its own control — managing which of its people have access, keeping credentials secure, and removing access for people who no longer need it.

No system can be guaranteed completely secure, but reasonable steps are taken to protect personal information from misuse, interference, loss and unauthorised access.

9. Data Breaches

The Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth) applies to eligible data breaches likely to result in serious harm.

If a breach affects information held on this platform:

  • TEKRAM will notify the Market Operator without undue delay after becoming aware of it
  • TEKRAM will contain the breach and assist the Market Operator to assess its likely consequences
  • The Market Operator will notify affected individuals and the Office of the Australian Information Commissioner where required

10. Cookies & Tracking

This website uses cookies to keep the platform working and to understand how the public pages are used.

  • Essential cookies — required for the site and platform to function, including session, login and security cookies. These cannot be switched off.
  • Analytics cookies — used on the public pages to measure visits and improve the site. These are not used inside the stallholder dashboard.
  • Preference cookies — remember your settings and choices.

You can block or delete cookies through your browser settings. Blocking essential cookies will stop parts of the platform working. Cookies are not used to serve advertising or to track you across unrelated websites.

11. Data Retention

  • Active stallholder accounts — retained while the account is active and for maximum 1 year after last activity
  • Financial and transaction records — 5 years, the minimum period required under Australian tax law
  • Compliance documents (insurance, licences) — retained for the term of the stall licence + 6 months
  • Incident records — retained for maximum 7 years, in line with insurance and limitation periods
  • Enquiry and contact form submissions — up to 2 years unless part of an ongoing relationship
  • Website analytics — aggregated or anonymised after 26 months

When personal information is no longer required, reasonable steps are taken to destroy or de-identify it securely.

If the platform agreement ends

If the agreement between Caloundra Markets and TEKRAM ends, the Market Operator can export its data from the platform for 30 days after the account closes. TEKRAM then securely deletes or de-identifies it within a further 60 days, except where a copy must be retained to meet a legal obligation.

12. Your Rights

Under the Australian Privacy Principles you may:

  • Access — request a copy of the personal information held about you
  • Correct — ask for information that is inaccurate, out of date or incomplete to be corrected
  • Opt out — unsubscribe from non-essential communications at any time
  • Complain — raise a concern about how your information has been handled

Send all requests to Caloundra Markets using the details in Section 17. As the Market Operator, they are the party responsible for your information and will respond within 30 days. Identity verification may be required first.

If you contact TEKRAM instead, your request will be referred to Caloundra Markets and you will be told that this has happened. TEKRAM will help them respond, but will not release, amend or delete their records at the request of a third party.

Dealing with us anonymously

You may deal with the Market Operator anonymously or under a pseudonym where it is lawful and practicable — for example a general enquiry about market dates. This is not practicable for applications, bookings, payments or compliance verification, where identity and business details are required.

13. Marketing & Communications

Transactional messages — booking confirmations, reminders, site allocations, invoices, cancellations and account or security notices — are part of the service and are sent whether or not you have opted in to marketing.

Market newsletters and promotional announcements are sent by the Market Operator only where you have opted in. Every commercial message includes a working unsubscribe link, in accordance with the Spam Act 2003 (Cth). Unsubscribing from marketing does not stop transactional messages about your bookings.

14. Children & Young People

Stallholder and entertainment accounts on this platform are for people aged 18 and over. An application involving anyone under 18 must be submitted and held by a parent or guardian.

The markets themselves are public, family-friendly events open to all ages. This policy applies to the platform, not to attending the market.

Personal information is not knowingly collected from children under 18 through this platform. If you believe this has occurred, contact Caloundra Markets and the information will be deleted.

15. Links to Other Websites

This website links to sites operated by others — stallholder websites and social media, the Market Operator's main website, council pages and payment providers. Those sites are not controlled by the Market Operator or TEKRAM, and this policy does not apply to them. Please read their own privacy policies before providing personal information.

16. Changes to This Policy

This policy may be updated from time to time. The current version is always published on this page with a revised “Last Updated” date. Where changes are material, active stallholders will be notified at least 14 days before they take effect.
